Ignorance is not considered to be a valid excuse, when on the spot fines are being issued.
This subject is quite a complex one. There are different regulations between residential and commercial / industrial asbestos removal. There are further regulations depending on what State or Territory your property is in. At Asbestos Central Pty Ltd we have $10,000,000 coverage for Asbestos Liability as well as $10,000,000 each for Public and Products Liability.
Whom ever you choose to have your asbestos removed by, it is critical that the Company is fully licensed with either a Class A (friable & bonded) or Class B (bonded only) License. If you ask the Contractor for their Asbestos Licence Number you can ring your closest WorkSafe office and have the number verified to make sure they are still allowed to be removing the asbestos.
It is YOUR responsibility to ensure that you have licensed contractors on your property. WorkSafe have inspectors on the road all day, every day to catch people out that claim to be properly registered and insured but are actually not. On the spot fines are issued to both the contractor and the property owner.
It is also recommended that you ensure that the Company has their Asbestos Liability Insurance up to date. They should be able to produce a copy of it when they arrive on your site. It will be in the form of a Certificate of Currency and will probably have Public and Products Liability attached to it.
There are only a two Insurance Companies that will insure for asbestos liability. One is Loydd’s of London and the other is AIG. You need to make sure that you sight a Certificate of Currency from the Insurance Company and not from the Insurance Broker.
